Probably because there is always a person in each and every online game that allows dueling once the duel is refused they still seem to /whisper and pester you and even after you say no thanks they will harass you. Even if ZOS added a on/off feature there will always be a person that will spam emotes /scared and follow you with with /bucket splash. Not to mention if you do decide to accept a duel and then lose they will most likely do /push-ups and /lol.

I asume by now most people have figured out how to fight in this game.
And the justice system is a perfect means to bring duels about with a real purpose rather than just because.
I dont support, if they do duels, players learn too much of the game and start to whine nerfs/buffs. All it needs like 50 duel with your mates, and both classes's weaknesses and strenghts are found, then they come to the forum with details and tell Zen, why your game sucks.

it changes the players from a healthy mix of adventurers and min-maxers, to 99% hardcore min-maxers. then everything becomes a numbers game. And the e-peen mentality... oh god....
MAYBE, just maybe, if by default it's turned off. And it's limited to small spaces only. Like the Arena idea, wherever that went...
