I get it. My post was directed specifically at the OP, who doesn't seem to be a fan of the opt-out system since inability to kill other players apparently breaks his immersion and he wants to, I quote, "kill everybody in their way."

Unless its a completely separate sever there is no true opt-in / opt-out... ESO would lose more then half its player base if it has open world PVP and I bet they will lose many if they cant figure out the NPC ganking / mistake ganking / AoE issues in groups etc, that will happen with the "justice system"
If your gameplay is not impacted in a meaningful way then as far as I'm concerned you're "truly" opted out. If you can still complete your quests and sell/buy from vendors there is no actual impact on your gameplay. Is there an impact on atmosphere/tone? Yes, absolutely. Whether that's a positive or negative impact is a matter of opinion.

You have too much faith in Zenimax who cant even get 1 zone of PVP to work...

Try: maybe lots of people would leave the game because of griefers. Gankers abound!

I have no opinion about opt-out because I haven't played other MMOs, so I don't know how it usually works out. I'll wait and see when the Justice System arrives.

Oh really? Tell me again how WoW lost subs because of ganking. They have the open world PVP and it was doing great, not everyone is an a**hole you know?

Sadly, most a**holes or badmouthing players I encountered in open world pvp - and no I don't mean the 'usual' trash talk.
You might want to check the server populations of the pvp servers ... you wont find a lot of healthy servers with a 50 to 50 ratio of population ... ppl who could afford it moved to a server where their faction was dominant, others just rerolled. And sadly since vanilla most world pvp consisted of end level toons 'ganking' low levels to start a 'real' fight ... and that rarely worked out ever(ofc only my personal experience ... ).
If they manage to introduce a system where you truly can op out completely (not like rift or swtor at start, where your buffs or grounded heals flag'd you for pvp, just cause someone ran into it) I don't mind for open world pvp ... but only time will tell.
If they set up a separate server for open world pvp that would be great for the people who are into it. I'm not though and open world pvp would probably see me leave the game. There is already a pvp zone and if they do a dedicated open world pvp server then that's enough. Not everyone likes pvp and shouldn't be forced into it.

Well, it happened a lot on PvE servers...)
And of course, in many instances such games are annoying for a lot of people through endless ganking while they try to do their questing... though of course some thrive on it too.
However... ESO has a different setup, with three fractions and regions divived between them, with only cyrodil as "war torn meeting place" and a few other regions that the fractions could logically meet in, but currently don't (coldharbour, craglorn).
Thus unlimited world PvP is not very logical... unless someone goes "bandit", which may come as add on to the justice system one day. And then I hope it will add some stiff penalties for bandits too, not merely a short waiting period before you can walk into town again...
But the game here has room for expansion... they could easily add combined PvE/PvP regions where people stumble over the other fractions while following PvE quests just like in one of those other games... but without keeps and all that. Who knows, maybe they might even change craglorn and coldharbour to that, though considering the story, in those places it would make more sense for the different fractions to be in an uneasy alliance against a larger threat...
They could also add arenas and other small scale PvP possibilities. Time will tell, I suppose. Though I would want to see all the details of the justice system before making noise for yet more...

Maybe a few people don't like this system but, why not implement a PK system on the big world of Skyrim?
