I think you (and ZOS) may have misinterpreted the use of the word "persistent"
I dunno about special cases, but most particle effects on UNSHEATHED weapons are temporary - when you draw your flaming enchanted sword, it bursts into flames, burns for several seconds, then dies down to a normal sword. Many of the weapons also burst into their respective magical whatever when they actually activate their effect, stay burning for a little while, then die down to normal as above.
I think it's quite possible that when ZOS used the word *persistent*, they expected that it meant that the magical flame effect would be on as long as the weapon was drawn (whereas now, it's only temporary when the weapon is drawn) - technically, as far as I know, NO weapon has had an active particle effect while sheathed, which is why they probably felt that the word persistent would common-sensically apply to the only time when weapons have ever had a particle effect : namely, when they're drawn
of course, over the years, I've discovered that one person's common sense is another person's abject insanity, which is why I wish people would stop using the term "common sense".

I think you are right. Also, a burning stick on your back is a health and safety issue.

Preview shows that all weps have fire effect permanently, and when they in sheath too. I purchased the bundle and thought that now my char will be rock-n'rolling with firing blunt behind my back, but i was misrepresented, because firing effect is only when it is ready to cast, without any firing effect when it's behind char's back.

You cannot sheath weapons in the Crown Store preview window, and they are previewing as intended at the Outfit station - active effect when armed, inactive when sheathed. The Skyforge Smith Hammer style already functions like this so doubtful that it's a bug.
So I'm failing to see how anything is misrepresented, other than the existence of a sheathed weapon preview with the effect active.

Well they gave him a refund so I guess they succeeded in seeing what you failed to see
I don't know what a "Gotcha!" culture is, but I think all of just read "persistent" to mean "always there", which is what the word means. There wasn't anything to suggest that there was any reason to ask for clarification. What would we have asked? "Gina, when the marketing team says persistent, do you think they might actually means sometimes? Could you check into that for us?"
I take persistent as a synonym of 'extended' or 'longer than usual'. As in a persistent cough or a persistent telemarketer. There's no perpetuality inferred from either.
I agree that it may have been better to actually describe the effect rather than let one word do all the heavy lifting, but 'persistent' and 'perpetual' are two different things.

Jesus. Give it up. You're embarrassing yourself here. Unbelievable. The onus should always, always be on the seller to advertise their products clearly and concisely. It's not for the buyer to start second guessing. The fact people are talking about this, means ZoS failed to advertise their product clearly. The fact you even attempt to make out the word "persistent" can be construed this way or that way means ZoS have failed miserably to advertise their product in a clear manner. Yeah, you might enjoy second guessing manufacturers or sellers when buying your goods and are willing to accept any or garbage thrown at you, most of us don't.
