Is playing the game while downloading the patch against the ToS?

Trust me, it is possible to play the game while downloading the patch. I just want to know if it a violation of the ToS.

    Why would it be I guess is what I mean. Hell, WoW let's you, and downloads and applies the patches as you play...

    Other than large patches I'm not sure why they don't do this. I love that Blizzard made that an option. They would start to push the information to you if you set it up to where the next patch would download while you were playing. Then when it went live the launcher just had to check and verify the files before letting you log in.

    When i tried to log in to the new server with the old client (clicked play during the brief time today when EU server went up but there was no patch to download yet), i got an error message 'you are trying to log in with an old version, please patch first'. So i'm not sure how you could play before you download the patch.

    The patch hosed my launcher installation. However I can play by using eso.exe. In the meantime, the launcher is still downloading gigabytes worth of files.

    That is a nifty feature for a 10 year old mmo.

    Not sure if you're insulting WoW, cause it's still the most played MMO, and they added it a while ago.

    I started playing WoW in vanilla. Does that give you a clue?
