do companions need to be active for me to benefit from their perk if rapport is max'd?

Look under Collections/Upgrades. The companion perks become permanently unlocked, even if companion not active, once you get certain upgrades. They are tied to achievements, and max rapport is always part of the achievement, but there are other factors that generally fit in with companion personality. Like for Sharp-As-Night, you also need to go fishing with him and visit a hist tree and a few other things.0
