Question about Shadowy Disguise (Nightblade skill)

So. Can you NOT use this skill to steal from NPCs?
Whenever I try to steal from NPCs in front of them using sneak and shadowy disguise, it always ends the skill EARLY and they always catch me. It's as if I never bothered to go invisible in the first place.
In contrast, if I use an invisibility potion, I can safely rob the room blind (for as long as the potion lasts).
Is this how it always was? Or did I come upon a bug?
EDIT: Just to clarify, this is NOT pickpocketing, but stealing from containers in front of NPCs.
