Nightblade Surprise Attack

Slash an enemy, dealing 2399 Physical Damage and applying the Sundered status effect. If you strike an enemy from their flank you set them Off Balance. This attack will also be guaranteed to be a Critical Strike, up to once every 4 seconds.

Surprise Attack does not set enemy off balance from the flank in Cyrodill against NPCs and players.

    Did you try using it from the south of 5ge target?

    I don't even know what that means. I was in a delve in Cyrodill. I was sneaking behind the npc. I used the skill and the npc simply just stood up and/or turned around. There was no critical strike, no sundered status effect, and no off balance. This happened repeatedly for about an hour. It went back to normal once I left Cyrodill, but I have been noticing that it doesn't work as advertised in open world either. You don't have to sneak to get it to work. I sneaked up to the enemies to test that it wasn't working directly behind the enemy.

    You should have a compass across the top of your screen. If you are facing north and hit the NPC, do you set them off balance? Because there's been a bug reported that the cardinal direction is what's deciding if you are flanking

    I entered the delve from the south. I worked my way in. I probably was facing north.
