ZOS is NOT obligated to communicate with you

It’s literally written in the TOS:

“ZeniMax may patch, update, or modify a Service at any time with or without notice to You. Notwithstanding the foregoing, ZeniMax has no obligation to make available any patches, updates or modifications or correct any errors or defects in the Services. ZeniMax makes no guarantees about the persistence or availability of any user names or other personas at any time and assumes no liability for lost or deleted Account data. Except as prohibited by applicable law and subject to the Statutory Obligations (as defined in Section 1), You agree that ZeniMax will not be liable for any interruption of the Services, delay or failure to perform, any loss of Content (including, but not limited to, UGC, Game Mods and Downloadable Content), and/or Account data (including, but not limited to, Character data) resulting from any causes whatsoever. ZeniMax reserves the right to offer new Services, change and/or discontinue certain Services at any time in its sole discretion.”

If you want the devs to communicate with you, maybe play a different game?

These kinds of TOS exist for nearly every game.

They are written by lawyers, not the game developers/ community managers. To ensure that they aren't in any legal issues for anything they decide to do in the future. If they turned the servers off tomorrow they wouldn't be in any legal trouble because all players accepted these TOS.

Obviously, they aren't going to write themselves into a wall by saying
ZeniMax will patch the game every 4 months, and will make sure to communicate with each player to ensure they are happy with the patch before pushing it live

That doesn't mean you can't wish they communicated more. Obviously, you're not entitled to anything, but you can ask.

I don't think anyone is suggesting that ZOS are required to do anything. Players can ask and may choose to play something else if they are unsatisfied. But all this TOS is doing is ensuring they won't be in any legal trouble.

    Ok?

Nobody is required by law to do all the little things we do in life to be polite. But you're going to have to live with people being annoyed, and saying so, if that's your operating principle.

Nobody will be able to throw you in jail for it though.

While not mandatory, its stil a nice touch. Kinda like tipping the deliveryman/ waiter at a restaurant you're not forced to do it but its nice and appreciate

A simple "hey guys we ran into a problem durring maintenance" would be more than egnough for me, no compasation needed

Yes and we are also not obligated to play or spend money on their broken game so it works both ways I guess.
