Like the title says the NA server is "fine" yes at peak hs it has some problems but no anything new, my question is why the EU server has so many problems?
Also why we always have the same problems and bugs back? i think the root cause is the game sofware.

Its the same reason that PC/EU has had problems all year: PC/EU players have the highest number of concurrent players of all of the servers, and something can't handle it. They expanded their hardware back in May and we seem to be hitting the limits again. Then their software or their databases seem to bottleneck in various places under high demand, like shoring up weak spots in a dam. This time it was activity finder. Other times it was multibidding or their databases.
PC/NA was approaching the same problems back in May, but got the same server upgrades. We also have more time zones in our primetime and a larger market for gaming consoles, so we simply don't have the same number of concurrent players at peak demand.7 -

AFAIK EU has a sizable number of users also from Asia and the Middle East, and some from Africa while NA has some from East Asia and Oceania. IDK how popular ESO is in South America, but the fact they didn't bother doing a Spanish version (!?) indicates that it's not an important market for them. US side of the house isn't so dead compared to EU. However, I do enjoy playing on the EU side of the house cause there are much more friendlier players. Ahh sure, you still have the arses and scammers as US side does, but seem to be less on the EU side.1 -

That's what matters: server at peak times.
If server could perform well under stressing loads, it would perform well at any time.
Fyi I'm playing PvE n PvP in both servers atm (during peak times and times with less players online): NA performs a bit better but there's a lot more players in EU.

Otherwise you probably should take a few lessons more which countries are part of the EU.
