Curious about 2.3 of the ToS and mistreatment of a player

The biggest thing that bothers me is how when asked ZoS never actually responded with a human. it was always an automated email. That is why I started this post and why I wanted answers before I started naming more characters(I too have some I admire)

It isn't hard to come up with an original name, there's no reason to set out to name your characters after dead composers or other historical figures, and personally I'm glad the ToS forbid it as I've played other games where people are running around with such names and it just looks stupid and out of place in a MMORPG.
Depends, sometimes it is out of respect or appreciation. Nothing bad with that. Not every character name needs to be some roleplay name, not everyone likes to do it

Nothing wrong at all with Antonio Vivaldi. In fact The nems Vivaldi and Bach are used in the Witcher series.Although only the surnames.

I actually researched a few of them. the composers no, the name Vlad Tepes Dracul no...
And you -really- think that would stop -some- people? Its not just the copyright owners who might sue, its also others associated witrh a name... especially historic names. From the mayor of a histpric personages birthplace to their fan club, who knows what people might "take offense" to see the name of their beloved hero/idol/whatever used in a game.

Even if it might not hold up in court, some people might try it anyway in an "I have a case the judge wouldn't just throw out, wanna take it through the courts or shall we reach a... 'settlement'..." in hopes ZOS may think its cheaper to pay some settlement instead of all the lawyer fees. Especially in some countried where poor people can foist off their own lawyer fees to the state (yeah, that's actually a thing in some places).

ZOS just wants to make sure they don't give any (legal) opening there, no matter how small the chances. Thus they go with tha classic "better safe then sorry" approach. Duh.

And as has been said, no report, no foul.
But IF someone gets offended, then ZOS takes a look to see if it might be justified offense... and then you need the classic "No similarities with persons living or dead" disclaimer (which really isn't at all possible if you are in fact using their name.)

And that's a good way. A surname alone is not exactly an issue, considering just how many people share one, right? As long as its not paired with the historically famour firstname, or with something degoratory...

Um, no, nothing remotely like .. please educate yourself about copyright law before spouting nonsense.

In the case of using a name of a person, living or dead, ZOS is protecting themselves. For example, some player is using the name of a politician, the real person finds out about it, who are they going to sue, some kid or ZOS? You would be surprised how far some people will go to protect their name or trademark.

Then they need to specify in the ToS, and not sure how people dead(some 400+ years) are going to sue

Somebody owns that dead person's name, and have a copyright for everything about them.

    LoL no.
Everything is public domain after 4 centuries xD

Really, that thing about Mozart, Chopin, Tschaikowski and co. makes zero sense. Someone simply wanted to be an ass and reported, and they found some stupid support guy to follow them.

The ticket system always starts with automated responses. You need to reply to that and restate your issue as clearly and calmly as you can. The forums won't give you any answers since we don't know all the facts and ZOS won't discuss actions taken on individual players or their leaving the game.

    Hello everyone,

With this thread getting a bit bashful towards the TOS and the company as well, which is against the Forum Rules, we're going to go ahead and close it down. For further posts be sure to stay constructive and respectful when discussing such matters to avoid thread derailment.

    Thank you for understanding.
