New Zenimax 2019 Terms of Service (TOS)

Hi all,

Have anyone gone through the latest Terms of Service ? There was something i was not very clear on. It says that any content or user-generated-content are owned by Zenimax. This include any videos we make from the game and any screenshots. So everything we uploaded to Youtube video or put up a screenshot on the web it violates Zenimax TOS ? Each time we do, we need their consent ?

    Depends on how they define 'user generated content'.

    Also the new ToS is generic and applies to all Zenimax games and services.

    I don't think you're breaking TOS by uploading screenshot or videos, or streaming, since ZOS is encouraging it.
    They could, however, ask you ta take it down for whatever reason they'd see fit, for instance, if you associate ESO content with illegal stuff, or something damaging the image of the game.
    That's how I interprete it.

    I think its monatization of say a video made with their assets.

    I think they mean, if they like your video they are claiming rights to use it as they wish.

    Personally I suspect all the screenshots and youtubings are still "fair use" - as long as you do it to show off your ESO experience, and not try to use it in something commercial.

    Usually such terms are in TOS as as... uh... rear-covering; in case someone makes something and they make something similar without even knowing what the someone made, and then get sued with an "you guys stole my idea"... (Not that people in the gaming industry would ever steal ideas, really... :p:trollface: ), or because someone else wants to ste... uhm... borrow some ideas from ESO, and possibly use them in ways the powers that be would not exactly approve of... well... and perhaps most of all, so they can always use something like a nifty looking character outfit you assembled or player videos of gameplay for their own promotional stuff without having to pay someone if the need should arise...

    In the end, I expect it won't really affect us mere players.
