Should be Dueling In Towns be considered a Crime?

I think it should it is disorderly conduct and killing another players character even though they respawn should be considered a crime. As there is designated Areas especially for Dueling that are not being used in favor of doing it near wayshrines, inns and crafting areas. So what do you think? Do you think it should be a crime that guards will attack you on sight for or attempt to arrest you if you do it in any area not designated for dueling?

I don’t mind dueling as a thing but when trying to do my crafting writs or find groups for undaunted dailies/trials and I’m getting duel invites. Prime example stormhaven the wayshrine and next to undaunted camp is where most people I see dueling there is a location not far from stormhaven that is actually like an arena.7 -

I allowed a few newbies access to my home recently since they didn't already have access to one with crafting stations etc.
First thing one pair of them did was start dueling each other.
My first thought was "Oh great. Just what I wanted."
My second thought was "Well at least this means they're not doing it in the streets like rabid animals."9 -

Anumaril✭✭✭✭✭NoIf we apply our real-world laws to the ES universe then it would most likely be a crime to duel the way people do, but since we are living in a medieval fantasy world I'm inclined to say that the rules may be a little different when it comes to dueling one another.
I'm pretty sure that when you duel someone a flag is placed between the two to signal that they are having a duel, so that no one (especially a guard) thinks it is assault or anything of the sort. Based on the little flag alone I don't think it needs to be criminalised.
This next bit is going to depend heavily upon what the customs of the ES universe are, but I'll just give my opinion on it:
Dueling should not be a death sentence. If someone is killed that should be a crime. That being said, I think the mechanic for dueling should be that someone is defeated once their health reaches 1, at which time all DoTs etc are removed from them so that they can heal back to full health post-duel, AKA, since people are prevented from killing the other player in the duel, there is no crime/bounty. (I don't know if it already works like this or not, I never duel, but I think I've seen people die before)
That however, is simply my opinion on how things should work, the mere fact that you can kill people in duels right now just tell us that killing someone in a consenting duel is OK in the ES universe, and is seen as an acceptable thing. This would also tell us that the duels we see in-game are not friendly duels of any sort, but duels to the death based on some kind of wrongdoing from one of the two parties, perhaps as a way to settle disputes between regular citizens.Edited by Anumaril on February 28, 2019 8:53AM1 -

— They always claim they’re “investigating” the causes, but in reality they’re just waiting until the PC EU players go to bed. Once that happens, you can suddenly log in again and they happily mark the issue as Fixed.15 -

✭NoNo, but there are places where their fight deserves no respect at all and horse trampling should be encouraged. Those places are the Vivec crafting area and right in front of wayshrines. In other places I do my best to steer clear, just like I would walk around or wait while someone tries to take a picture in real life.1 -

Except that I sometimes like to duel. I'd rather not go through opening and closing my menus to toggle it. Console doesn't make that a quick option.
If there were designated dueling areas in every major city, away from crafting and wayshrines there's no reason to get the justice system involved. It's just annoying in certain places. It seems that some like to duel in crowded areas either for LoS or to mess with targeting.
