Because the only time it's an issue for me is during the New Life Festival when I need to throw mudballs at neutral NPCs.
Sounds like someone needs to do a cleaner job of leveling up the Thieves Guild ... rather than asking for wholesale game mechanic changes.

It's bad enough (and it is really, really indefensibly bad game design) to put a "commit murder or get killed yourself" mechanic in Main Quest without at least having some story fallout for it. "You're trying to save the world, but you can't actually do that and keep your hands clean" is very Elder Scrolls. But it's not a scripted story beat, it's simply bad game mechanics. It should never have been allowed to go live like that. It may seem like no big deal to many of you, but to me, this is "someone should be fired over this" levels of incompetence.
Then, to this insultingly bad design decision, add the PITA of having to dig through menus just to defend myself, and you'll see why I agree 100% with the OP and and shaking my head in disappointment at those who disagree.

The quests that have you sneaking into a restricted area. I completely forget its turned on, and I get beat on while I go to my options, and try to turn it off quickly, just so I can fight back. Are they really innocent if they are attacking you unprovoked, or at very least, unattacked?

Though the first time I hit it I was pickpocketing. They are no longer "innocent" if they start beating on me! That is not a "big game change" that is a "let me fight back without digging around menus" change.
I DO NOT want it on all the time, especially running a pet sorc for one of my characters.

[That's one of the reasons I haven't bothered with getting interested in doing quests on Vvardenfell and Clockwork City... the forced unavoidable law breaking interspersed in them... at any point when I reach those kind of situations, I abandon the quest and forget about the content... that's BAD design for a game that's supposedly intended to be an RPG.
