It's not wrong. What we're trying to perceive is the gryphon continuing a flight to the left side of the image. Much like this:
However, based on the angle of the wings, the Gryphon is changing direction. So the right wing is taking more drag and the left wing is angled toward its new target, which for point of view purposes is us.

If the left shoulder was dipped a bit and back a touch, I think it's a great image. The body just doesn't show enough curl to depict the movement of the left bank as well as the wings do.

The Khajit on the Hew's Bane loading screen also drives me insane (dat head!!!).
In the defense of the artists though, these detailed scenes require skills in anatomy, architecture, lighting, props, color, vegetation all at once, all of which are quite tough to master single handedly let alone together. I myself enjoy drawing floating heads to which I've been known to add a body but you'll never catch me drawing a background for FUN and that is probably why I'm skillwise at a standstill but I DIGRESS
