Yeah. The expiration on that cookie is extremely short. Not to mention that it's the only gaming website as far as I know that even does that.
My theory is that a staff lawyer with too much time on his hands thought that one up back in 2014 and it became corporate policy. It's always the lawyers that screw things up.

I am on the other side of this. I would not be comfortable actually giving my full date of birth to Bethesda and ZOS. My feeling is that they do not need to know this information. Most companies who ask me do not need to know this information, and if they do need to know, they need to explain why. There is nothing on the ESO age gate that explains why they need to know, whether they save that information, or what they do with that information.
In this case, Bethesda and ZOS just want to know that I am adult per whatever reasons they have, and I am an adult, so as long as I provide an answer that reflects that, I feel that I have provided the information that they really need.

Reason they dont remember it is the same reason they cant check those dates. They simply arent allowed to store the numbers (or at least are pressured against saving)
