The answer is that ZOS can take action against a scammer. Whether they will or not is up to how they're feeling that particular day. You'll also never know if any action is taken as it's policy to not tell you.

Secondly in relation to the scamming I don't know, from past threads it sounds like ZOS won't ban the scammer but they will get your money back if you create a support ticket abut the issue. it was just a heads up but it can result in things like i said ie: Use your account to trade services or in-game content for memberships, games, gift cards, account credit or content, Lend, transfer, sell or otherwise

Yeah, that's why. Hell, I'm facing a much smaller example of this in one of my guilds now. We had a pair of former officers who were using racial slurs in discord, so they got booted, and now they're trying to paint me as, "mad with powah," to anyone who will listen.
With respect to you, and your intentions, @Prohn, we don't know if you're acting with clean hands. This doesn't mean I don't believe you, but people who start witch hunts in retribution do exist. That's why that rule exists. And it's the same on Reddit. We've had people try to start witch hunts, specifically, to go after people who irked them, by painting them as scammers, bank thieves, and worse. We don't have the capacity to verify what you're telling us. Customer support does.
