They can't do anything about that. Unlike PC where they have direct control of the servers at any time and can roll out patches and hotfixes at will, for console they have to schedule that sort of thing with the platform providers every time. So any bug fixes and performance patches can't be rolled out quickly. That is not ZOS' fault, you can blame Microsoft for that one.
The fact this patch even made it to the servers with a bug that freezes everything and renders the game unplayable for some should never have made it to the console. It's entirely ZOS fault. Saying the blame lies on Microsoft when ZOS are the ones that pushed the patch out is unreasonable at best. As I understand it, that's a scheduling thing and also related to the fact that other titles generally have bigger teams for their divisions or were developed from the start with consoles in mind.
It's not like the devs are sitting around going like "Hey, see those console folks? Yeah, let's delay all their stuff for no reason in particular"
