Zos needs to come out and say if gold for crown gifting is allowed or not

I can't find anything in the EULA/TOS which forbid it, plenty of people have raised it and asked them, it's a fairly straightforward thing you think they would have come to a decision on before pushing out the functionality that enables the trading.
But with that said, the terms around the trade of virtual currency are poorly defined. Virtual Currency can read as applying to both gold and Crowns, however neither of those play nicely with the TOS saying: ZeniMax prohibits, and does not recognize any purported, transfers, sales, gifts, or trades of Virtual Currency.

Which side of the equation is the 'real money'? Because the TOS are very explicit in detailing that Crowns have no value in real currency. They also fail to engage entirely with whether gifted items are subject to the same terms as Crowns themselves.

Some people enjoy the game but may not exactly have enough money to buy something they want and buying something from someone with gold is a fair solution assuming they price the item for a fair price.
I could see this being used by guilds for a giveaway or something. Some of the guilds I am in do lottos and a Crown Store item could motivate players.2 -

Yes and no. Its a resl money trade, but not between 2 players. Player one trades gold for an item from the crown store. Player two gives money to zos and then gets gold that a player farmed from within the game. It's different than adding money from no where and no player ever earns any rl money.
I actually like it. I just wish there was a formal system so I dont get screwed by another player only to be banned if I bring it up.

Crowns have no value outside of the game. It's defined as such in the terms of service. So it's not defined as a real-money transaction.

no it can't someone offering gold for a crown item is no different then someone offering gold for a ww or vamp bite. ZOS doesn't need to comment on it it's an at your own risk to trade gold for something either it being a crown item or a bite. If someone gets taken advantage it is their own fault because of the risk. It is not ZOS's job to think for people or help them use common sense. no it can't someone offering gold for a crown item is no different then someone offering gold for a ww or vamp bite. ZOS doesn't need to comment on it it's an at your own risk to trade gold for something either it being a crown item or a bite. This really isn't a hard thing to grasp and understand the risks involved with gifting.
Are you maybe missing that the reason people want comment from ZOS is that there's a possibility they start banning people for trading Crowns for gold, despite their TOS not making it clear whether it's permitted?
Frankly, they either have a position on the matter which they're withholding (which is a pretty bad faith way to handle your TOS) or they don't have a position and they're scrambling to come up with one (which is itself fairly outrageous).1 -

I mean you can purchase a bite in crown store then lvl it up and sell the bite for gold same thing you used real money to purchase something that can get you gold for it. You all just assume that it is against TOS, again common sense just need to use thinking and you'll be okay just give time. You really think that they can chase people that offer it as a gift and who is to say that person in gratitude gives them gold? Point being is you people are making it a lot bigger deal then what it is. ✭✭✭✭Since both are digital currencies, and the transaction doesn’t keep ZOS from making a sale (since someone already bought crowns), they probably are going to “allow” it on a buyer-beware sort of basis
real money transactions are generally only frowned upon because they deprive a company of a sale. ex. Buying an in-game motif page with real money means ZOS isn’t getting that money, hence it being prohibited.Edited by Jhalin on May 26, 2018 4:42AM0 -

Did you read the post before you replied? I didn't say it was against TOS and most of your tirade is directed towards that point.
Do I think they CAN identify people who exchange gold for Crown gifts? Trivially. It's a trivial thing to generate a report on occasions where gold was exchanged between parties who previously had no interaction other than gifted Crown store items. It requires only minimal tweaking to any existing real-life trading identification mechanisms.
The simple fact that there's confusion about it and that many people strongly believe it IS and strongly believe it ISN'T a TOS violation suggests that a clarification is in order. Why are you so up in arms about a request for clarification? Settle down.0 -
