Oblivion enchant was designed with a trade-off in mind: do less damage, but the damage is unresistable, ignoring shields and block alike. The other enchants on the other hand did not go through shields/block, but did significantly more damage to compensate.
The problem with oblivion enchant today is that after battle spirit reduction which halves all other direct damage enchants, oblivion one ends up doing the most damage, on top of also ignoring block/shields, effectively removing the trade-off mentioned above, and making all the other DD enchants obsolete. You have a valid arguement,but in all honesty I do not see this as a major issue. In order for that enchant to kill you through block(or even have to worry about it) is if you have like 10% hp,which leads to the sad truth,that you have probably already lost the fight anyway.And shields,unless you're stacking it with shieldbreaker,which would also mean you pretty much lost the fight^^,it really doesn't much of a difference.

Like most games, true damage (or Oblivion damage in the case of ESO), the counter to this is having more health (or not being hit with this damage with low health).
