Can't do anything when a guard finds me

It happens around 50% of the time I'm caught stealing something and a guard notices me. I can't choose to pay or flee, I can just stand there and wait until he kills me so I can relog. This moment was especially hilarious because of what the guard said to me:

Yeah, sure...

It's pretty annoying, especially when I have a few thousand worth of stolen goods that I can lose just because of that bug.

    If your bounty is high enough the guards will attack on sight.

    LOL guards are easy to avoid and if you do messup just as easy to escape.

    All you can do is CC and run for the hills. Keep in mind they can break CCs, so don't just stand about =D

    dont even need to cc, if they trap you in stone break free, claw you, roll dodge if you stamina. if you mage, walk while spamming heal springs.

    Not every magicka build walks around with healing springs. I know I don't. And they will fossilize you so often you'll run out of stamina, so it's easier to just CC then gain some ground to prevent them from getting in range. But in the end, whatever works.

    if you are stamina you should be able to break free, dodge roll, sprint out of aggro range before they can kill you.
    if you are magicka you should have a heal on bar. you should also have stamina to with controlled use break free/dodge roll 3 times.

    if you cannot do either of those you should rethink your build.

    You completely misunderstood the problem. I was supposed to be given a choice if I want to pay or flee, but the dialogue window didn't appear at all, I couldn't move because the game thought I should be talking with the guard, but the guard just attacks me.

    And you can see in the recording that I had no bounty on me before I steal the stuff.

    From me watching the video your bounty grew to levels that I believe are beyond a chance to pay out. I am not sure if that part is correct though. Maybe you got bounty for being seen picking the lock and then more bounty for continuing to take what was in the chest. The messages in the top right show your various levels of crime.

    Perhaps when you got to the guard he rooted you somehow and you needed to break free. I see that your attack skills were shown below which seems to indicate the game registered you as in combat.

    The heat was still in the first zone, where I'm just disreputable. Otherwise the guard would rush over to me once I were in sight, instead I had to get up close for him to notice me. The heat went up to maximum when I the guard actually started attacking me, meaning the game thought I chose to flee, even though I didn't get to choose.

    I set my skill bars to be always visible. Also notice that the FOV was very low the whole time, just like during dialogues.

    Does this happen every time you have a bounty? Are you always in first person view? If so, have you tried it in third person view?

    It doesn't always happen, just around 50% of the time. I can experiment a bit with thrid person view to see if it makes a difference and tell you the results.

    Try disabling some add-ons, I think they can affect the dialogue window.

    I think I can share a lot of insight into this one. This happens to me a majority of the time. It seems to be a pathing error that effects the guards in certain locations. If guards have to go up slopes or stairs it seems like they can never quite "reach" me. So the guard will come close, I'll put my hands up in the air and they'll start to recite their dialogue, and one of two things happens:
    1. Guard spots my character, runs over. My hands raise up into the air, but the guard can never quite seem to get in front of me, and I stand there for 10-15 seconds, hands up, and eventually the guard just walks away. There seems like a 50/50 chance that the guard will either ignore me after (as if I was never caught in the first place) OR the guard will turn back around, move in again to accuse me again, not reach me, walk away... lather, rinse, repeat. I've had it happen up to 5 times before I actually got the dialog box, then I was able to use the passive to tell the guard to go away.
    2. As in this video, my character raises his hands in the air as the guard approaches, the guard skips the dialog and immediately begins attacking me.
    I notice this a lot in Wayrest, especially with the guard that patrols between the Undaunted and the Vendor area. That guard almost always bugs out for me like this.

    Guard catches me first time, everything goes as normal. Second time, the guard starts to chase, I'm stuck and can't react. Guard randomly wanders back, and I'm stuck for a few seconds unable to move. Seems like a 50/50 shot sometimes whether the guards walk away or attack (as in Furrik's case). If they walk away you can move. If not...

    Sorry for such a late response. I checked if this problem persist while having add-ons enabled or disabled and it seems it's not a glitch caused by an add-on, because it happens even with all of them disabled.
    What @Preyfar described seems to be different problem unrelated to mine, because it happens only when the guards actually can come near me. I'm completely safe when they can't reach me.

    Was hoping it's related as I've had it happen in a similar instance (thought it seemed like when I got stuck in the "hands up" pose it's because the guard's home position was close to where I was). If the guard ran too far out I'd eventually get free, but if the guard was still within their detection radius I'd get stuck in a situation like you're in.

    I have this exact problem, alot. No heat at all, and even with bounties as low as 25gold. No screen comes up to pay or run or use clemency. controls lock out and all you can do is chat. If you try to rez, you are frozen the same way, use /stuck, same thing minus the fee. The only thing that works for me is to relog.

    just got it again several times today throwing a mudball.

    It's really putting me off of the game as I like doing thief stuff. I don't mind getting caught, let me pay, run, get killed, whatever, but having to relog every time is a pain.

    I've been having the same problem and it's irritating to say the least. Running around with plenty of stolen good only to have a guard run up, start a dialogue with me and then cancel and leave me frozen and forced to watch myself slowly die. I can't log out, I can't leave, all I can do is sit there and wait for them to kill me and take my gold/stolen goods. It happens so often I'm afraid of stealing anything now and getting caught in this state again. Even after dying, I'm stuck in this fake dialogue until I log out and log back in.

    I have found a fairly easy fix for this glitch:
    Simply using a Counterfeit Pardon Edict or a similar item allows to play normally again without relogging, and quickly moving away stops using the item so there's no risk losing it. It also works while being attacked by a guard, but you need to do this quickly before the guard kills you.

    Yea this is a bug, I've experienced it many times on ESO Xbox One, whenever I would get caught there would be chance that when I did the view would zoom into the guard as if I'm about to speak with him, but the dialogue wouldn't show up and no matter what I did, I would be stuck, I'd have to literary press all my controller buttons rapidly and randomly hoping it will fix itself and give me a chance to run, sometimes it works, mostly though I just end up dying.

    I'm surprised this is just coming up and most people don't even know about it, I just assumed ZoS has been trying to fix it this whole time.

    You can't... you literally can't do anything, you're stuck on the invisible dialogue screen :|

    Did you try opening the inventory by pressing "I"? That's how it worked for me.

    This happens to me nearly every time I'm spotted by a guard, even with a 2g bounty, I was killed and locked in dialog mode. Also unable to resurrect, which requires a relog.

    You're a dingus. The best fix would likely come from a developer. If you're 9 years old then forgive me but as a QA Tester, I can't ignore your stupidity in regards to this bug. That's how bugs are tested, you go looking for the cause, we don't ignore the problem and hope it goes away.

    Edit: As for why I don't record video and post these bugs with a report to Zenimax? I'm paying them to PLAY a game, they're not paying me to QATest.

    The official comment seems to indicate that it is an issue specific to the OP, and not one that is extremely widespread and affecting all platforms.
