I think there have probably been bandits in Tamriel as long as the concept of items having value, and therefore being worth stealing, has existed. So probably as long as there have been intelligent races. Likewise I think pirates have existed as long as there have been ships and trade routes.
I think the first pirates might be the maomer, who split from the other elves either late in the Dawn Era or early in the Merethic Era.
Anything more precise would be difficult to say, because time didn't really exist in the Dawn Era so it's not possible to give dates or even put all events into a linear structure.

That would, imo, be the "Maormer" when they settled "Pyandoea" in the Mid to Late Merethic Era.

In what Era were the first Pirates or Bandits appeared in Elder Scrolls?
That sort of trouble started with the humans.

Bandits first appeared in the dawn era.
Pretty much as soon as some tribe had something the others did not, someone got the idea to take it by force. Could have been a good harvest. Could have been a shiny trinket. Could have been a bone club. Could have been a divines favor (Remember those two boys from that book, what was their names again... ah, yes, cain and abel I think...)
That's how bandits start, in principle. And that happened, one way or another, somewhen in the dawn of Tamriel history. Likely many, many times, for many bandit groups to rise, raid, and eventually either be wiped out, or become civilized themselves and turn into a kingdom. (because once they have all the stuff, they certainly start seeing the point in laws saying "no stealing allowed")
Pirates first appeared when people made boats sturdy enough to sail the seas for more then a day. Before that they were bandits - the only true difference between the two is that one rob you on land, and the other on sea after all.
