    I think you mean to ask - "Isn't that copyright infringement?" Also, it wouldn't necessarily matter which game came out first, just which video, between the two alleged copies, was created first ("fixed in a tangible medium" is the legal jargon). Personally, I don't see the resemblance, but that is not a legal opinion.

    People on here are throwing the word "trademark" and "copyright" around without knowing what it actually does lol.

    Trademark = Protects slogans, logo, names.
    Copyright = Protects the design. Your product. In this case it would protect the video itself.
    Patent = Protects the idea, the invention. If ZOS came up with a unique look for Elves, they would patent it.

    I hate the new trend of live action/CGI game ads.

    I don't like it either. Mainly because as soon as I see that little disclaimer at the bottom saying "Not gameplay footage" or whatever I immediately start asking myself why they're not willing to show the gameplay. Even when I've seen/played the game and I know it looks fine it comes across as if they don't want to let you see it until after you've bought it.

    Still it's better than the trend for live action cut scenes which existed briefly in the early-mid 90's. Those were godawful. They were horribly pixelated and the sound was terrible. But more importantly no self-respecting actor would have been caught dead doing scenes for a game back then, and even if they did the studios didn't have the budgets they do now so they couldn't afford to pay them. Half the time the 'actors' were the developers in whatever they could find that passed for a costume. If you were lucky they got aspiring actors who couldn't get any other work and costumes that looked like they'd been borrowed from the local drama club.

    Needless to say that was "the next big thing" for long, and they moved to doing cut scenes with in-game graphics or CGI.

    Ever play Privateer 2: The Darkening? The live action cut scenes in that had Clive Owen (he was the character you played - incidentally this was the first thing I ever saw him in), Brian Blessed, John Hurt, and Christopher Walken. All pretty big names (although now that I think about it, Clive Owen might not have been a big name back then). In fact the Wing Commander games pretty regularly got fairly big names for their live action cut scenes.
