Did they fix that? It used to be that way. I had that happen with my sorc pets back when I first started playing. I'll test it next time I log in.Mine doesn't care what spot I have them on.

If the ability is on one bar and is a "toggle", weapon swapping to another bar (or using another method of going to another bar) will cancel the ability.
If the "toggle" ability is on both the current bar, and active, and you go to another bar where the ability is slotted, it should remain active. Position on the bar should not matter.
Please post up video if you see behavior that is inconsistent with the above to help with tracking down if it's a bug or not.
