If a vr 3 and a 40 pve in a cyrodiil dungeon does the game still use the normal +/-5 since people are battle leveled to a certain level?

Should be battle leveled to v12, so shouldn't make a difference as long as you have battle leveling enabled.

Due to a typo in the system, the area was accosted by the Daedric Prince Moar Lag Brawls.
