You can't roll dodge, cc break or use skills in water... how is using that an exploit?

Most companies would probably treat using such a mechanic to lock players out of being able to do anything for 40 minutes of game time to constitute griefing and unintended use of game mechanics.
Fortunately though, ZOS does not enforce anything for the worst of offenders, so something as low-grade as this is good for a laugh without repercussions.
Doubt that either player in the screenshot reported OP, or that ZOS would have responded even if they did.

Using it is not an exploit. It provides a concrete advantage in killing an enemy that let themselves end up in the scenario.
