Justice system doesnt make a lot of sense.
A lot of things in ESO dont make a lot of sense lol

The way justice system should obviously work.
If an npc is alone when it dies and no other npcs are in the same room/looking at you from a distance, no bounty should start.

If you murder an npc near other npcs and other npcs see you, they should all bum rush you.
SAME with pickpocketing, but pickpocketing needs to be more rewarding, it started off good but got more "meh".

If you have a bounty, players should be able to attack you and you should be able to retaliate.

Simple: the victim reports the crime to the local authority after his death. Ghosts can travel really really fast, you know.

Not only that a victim reports the crime is kinda odd, but also that you get "detected" all the time when absolutely no one is around in a hundred mile radius except for a Torchbug that apparently is watching you trying to steal something. They must be Guards in a Torchbug disguise. Also funny are these cats in a room in the Vulkhel Guard bank house, they see you. And I'm sure they'd report you. Typical for cats.

I am pretty sure each and all torchbugs rat you out for just looking at someone funny.
    And they are everywhere...
Except in Cyrodiil. And Cyrodiil has no Justice System. Coincidence? Or conspiracy? You decide.

This is exactly how it worked in Oblivion. You'd be surprised how many similarities there are between ESO and Oblivion (more than between ESO and Skyrim).

I see it like this: if you attack an NPC and they don't die, they cast a spell to report you. In the US, you would call this spell "911". In the EU, you would call it "112"; in the UK, you would call it "999".
If you have a bounty, players should be able to attack you and you should be able to retaliate.
That is planned for the future, in a system that is called (interchangeably) "Justice PvP" or the "Enforcer System".

Ya it'd be cool if they integrated a prison like previous TES games. even if it were just one for each faction. Sometimes I rack up a bounty and I'd rather spend time in jail (give me some time to get food, let my dogs out, etc) and it be pretty cool getting to talk to other inmates..

"So, what are ya in for?"

Then after we got out we could just use wayshrine to get back to where we were

this would be great  ~)
    Meh!
