Here in the EU you are supposed to tell customers when terms and conditions change and what has changed. This is EU law but I never got an email telling me they were changing nor has anyone tried to tell us what has changed.

I understand that in the USA you can change the terms and not tell the customer but here things are more civilised - as it is regardless of if I press the agree button or not the terms are no longer enforceable due to a breach in contract law.

Well done Zenimax, your legal department *** by forgetting that you have to comply with local laws where ever you sell your product.

I am sure you, as an armchair lawyer, printed the old privacy policy.

So please do all of us a favor and compare your printed and archived copy with the one currently available in game, thanks for your help!

None of which is even remotely relevant to his point.

The point is that they changed the T&C without prior warning to the customer.

The reason EU law requires them to do this is that the consumer can opt out of the service BEFORE the new T&Cs come into effect.

To prevent, for example, a "handcuff clause" that hypothetically could require you to pay 3 Month's subscription as a penalty for cancelling a subscription.

I know this but is anyone honestly surprised of a US gaming company not respecting full local law of several countries? At least I know of no gaming company from the US that didn't have this happen at least once and at the end of the day nothing happened anyway...

    *sigh*

Having had this issue before with games, I can say with authority that when it comes to digital products distributed through digital channels e.g. you downloaded it, that it's only the laws from the country or state where the company is based that applies.

If US or MD laws stated that when you downloaded an electronic product you'd be giving permission to be hunted for sport by a fat guy called Bob, it doesn't matter if you were in Australia or Austria you'd still be subject to that same agreement. Of course, local laws would supercede such things, but with electronic media it's always the local laws of the IP owner that has legal precedence.

I'd think the same. Not their fault that we don't read it before playing, since we all have to press the "I Agree" button it's all fine.

This thread shows the basic difference between the U.S. and EU.

The EU is more focused on consumer/individual privacy rights at the expense of businesses/corporations.

The U.S. is more focused on the business/corporation's ability to profit from the information collected on the consumer/individual.

The company is surely bound by the laws of the land it sells it in? BTW I pressed 'reject' and it said I couldn't go online as I had rejected them
I should have read them, but I'm sure someone on here has a (European/UK) company legalese degree and can tell us what we had to agree to?

LOL pretty sure they have lawyers that have EU law figured out. Maybe you should take a civics class in your home country so you actually know what you're talking about. It's obvious you don't.

And if you're going to use words like civilized, learn to spell.

You do realise that we in the UK, you know, where English was created, spell words correctly, with other English speaking countries changing them to suit themselves. He/She spelt it right.. in the UK and Ireland anyway.

    MURRICA!!!

And you didn't address the actual point, just picked the little one.

English may have been created in England, but we perfected it. Just like many other things from Europe.

Indeed.. anyway, the point is this.. what was the difference between the old one, and the new one? I accepted it anyway, given that I want to actually play the game.

They are notifying you that it's changed. That's why you have to read it (or scroll past it and click a button claiming you read it) before you can start playing, so that you have been notified of the changes before you start using the service (aka game) under the new terms.

If you've already accepted it and are now curious, or just want to see it again there's a link to the End User Licence Agreement at the bottom of this page.

I do read these things occasionally and honestly most of the time it's not that hard to follow. Certainly easier than actual legislation.

It's also a pretty safe bet that Zenimax are not going to put anything crazy in there. Most of it is extremely basic things most people would probably think they don't even need to be told - like if Zenimax advertise the game as not requiring a subscription that doesn't mean you don't need to pay for an internet connection or that they will pay the cost of it for you.

(Incidentally it also says that you should print a copy and save it for future reference. Presumably for situations like this.)
