Once they were added in Skyrim they set a precedence. Same with followers.

Nothing would have to be explained beyond a statement of "We don't want players killing children". There wouldn't have to be some sort of lore explanation, if that's what you're getting at.

Fallout 2 with child killing went out in 1998.
Bethesda with their Fallout3 were unable to do anything with "don't kill children" law.
Really, i don't know foreign laws about that type of "scenes of violence".
If they did implement this in F3, they'd have lost a big part of european players(customers).
But, as it said before, there was no lore point to implement children in TES. This question about children in TESO Live was a provocation.
