I don't think it's an exploit at all. Think about it. You get caught (or receive a bounty) stealing when someone witnesses your crime. You are invisible. Even if they notice the desk drawers opening, how would they report you? They can't see you, therefore cannot identify you.
As well, the fact you need to farm the materials the make the pots (or purchase them - high cost) will stop some people. Those who harvest a lot anyways and have the extra materials will profit.

At a guess they did this because allowing Nightblades to do this at no cost would be unbalancing (the only resource you're expending to be able to collect a bunch of stuff with no consequences is magicka, which regenerates for free), while allowing potions to be used for this is inherently balanced out by the fact that you're using up alchemy components to do it.So they removed the ability to steal while invisible for Nightblades, but left in the ability to steal while invisible by using potions?
@ZOS_JessicaFolsom or @ZOS_GinaBruno is this an intended use of invisibility potions, or did the reports of this issue on PTS get missed?

I bet the design process on that was something along the lines of "How could we make Shadow Cloak even less useful of a 'skill' than it already is? I know! Respect your point of view; but, since one version of this technique was removed, would much rather receive some official response as to whether this is intended or an exploit.
