You are a guard permanently, at least as they've currently described the system. That means that once a crime is committed, you can immediately bring the criminal to justice (or die trying). I can't imagine they're going to implement a system where everyone in a specific area suddenly gets a pop-up asking if they want to be a guard.

Justice System first I think, Thieves Guild and Dark Brotherhood will either be at the same time as that, or not long after.Are they implementing a Thieves Guild first?

When your sent to jail all your items could get dropped in a temporary bank space you can retrieve later when returning to the bank. While your in prison you meet someone that starts the quest and your option to tunnel out. While tunneling out, you connect to a "delve" and work your way out picking up basic weapons to fight the ugly's found in the cave. There could be draugr's, spiders and all kinds of little creepies to fend off down there.
That would be a lot of fun to complete and actually gives people an incentive to take the prison sentence.
