justice system (cannot see if i am in sneak when looting items)

when i open a crate, barrel, or drawer, or Any item at all to loot contents, the item content picture completely hides my sneak eye and i have no idea if i am still in sneak or not because i cant see my sneak-eye.
all that can be seen when opening a container of anykind is the picture of the contents of that container.
i was in sneak when i clicked on the container so i know i was in sneak but, if the guard or other player see's me or has seen me while looking at the contents of that container while i examine the contents then i run a high risk of death.


EDIT:
are we KOS upon stealing said item, or after the guard has spoken with me about said item in my inventory that was stolen?

    I thought it was automatic that we went out of stealth while container diving.

    That's only Locked Chests and Harvest nodes I believe. Your average everyday crates, barrels, nightstands... etc. can all be looted while in stealth.

    The indicator says briefly you are out of Stealth when activating any container, but you go back into stealth after. Now, I don't know if you are actually out of stealth or not while opening the container. It could just be a UI thing.

    However I did sneak up on a plant this morning and the mobs did not detect me until I tried to harvest it, then they aggro'd. I did move slightly closer to the container so it could have been more the distance aspect.

    However I am sure they are going to revamp the whole stealth/container aspect for the Justice system so that anything we are doing now will change when that system comes out.

    The eye opens whenever I activate a container and closes again when I close the container. As far as I can tell nothing is opened from stealth. Justice system has not been implemented yet either.

    Nobody knows, it's not even on the PTS to test with.

    one thing I know, is that the Nightshade set (3 piece) elderscrollsonline.wiki.fextralife.com/Nightshade+Set will most likely help with the sneak/steal equation, and they will be probably be in "Demand" when the Justice system goes live. I use this set with Kotaro and 9 times out of 10, I am way harder to see by enemies in PvE and PvP since he is already a Khajiit Nightblade with all the passives.

    the window is allready off to the side of the sneak "eye"
    when we open a barrel or urn or w/e the eye completely disapiers and we have no clue if we are in stealth or not.
    i should 100% of the time be able to see that eye and know if im being seen.

    Again, the justice system has not been implemented yet, so don't assume that the UI for sneaking will remain the same.

    And we don't know the exact mechanics, but the devs have been fairly clear that you won't immediately have a bounty that forces the guards to kill on sight for a small theft. Then again, the justice system has not been implemented yet, so we won't know for sure until we see it on the PTS.

    I was gonna say that we could just listen for the "CLANK" noise but next maint. patch (Monday 11/24/14) they are removing it..
