Merciless Resolve using stacks with no damage & Incap Strike Not firing at all

Had no issues until the recent patch but now my ultimate incapacitating strike shows 500 ult but is greyed out. Merciless resolve also is not firing but taking the stack amounts away. The character makes no animation and again, no damage but uses my stacks.
This is a PVP and PVE issue tested on PC NA with multiple characters and with others trying to recreate this.
It seems to happen much more often when testing after a dodge roll or directly after casting another ability (global cooldowns issue?).
Incap seems to fire 50% of the time when it is not greyed out. If it does fire it seems the merciless strike does not land after ~40% of the time.
