NB Dark Shade illegal in front of Vivec City?

Just in front of the the door by the wayshrine to enter Vivec City, on some weird occasion you get a bounty (around 200g) after using Dark Shade and the guards are instantly becoming hostile.
It's not an ability marked with the red "criminal action" so I'd assume there's some bug to it.
