I can't see the logo clearly, but a circular dragon(?) biting its own tail doesn't seem like an infringement, since a serpent biting its own tail is a very old and well-known image:

ESO's version of an ouroboros is distinctive for a reason, so unless Mithril Interactive's ouroboros has three heads biting three tails, or something like that, it would be difficult to prove that any sort of infringement occurred. But I'm no lawyer!

Looks fine to me. Maybe "Dragonborn" is copyrighted by Zenimax, but that doesn't mean every other fantasy title ending with "-born" or "-borne" is copyrighted, too. Also, the ouroboros is definitively not the one used by ESO.
