Literaly banned for a joke

MilkAndC00kies
Greetings,

My friend got banned today for writing the following in zone chat (his intention was to write it in guild chat as a joke): "WTS gold for litecoin". Yes it is a very very bold move, but who the hell would say this on an account with around 48k achievement points, pre ordered new chapter and half year of ESO+? Beside no gold transaction linked to the account he got banned anyway, also he had never ever violated ToS or anything before.

I would like to see this action be reconsidered. Here is the support ticket number: [230424-000129].

PS: He has no ESO forum account, Thats why i posting this.

Claiming something is a joke, after the fact, is in fact, not a good or credible defense.

Then tell me a credible defense in a similar case because i know for sure he never did or intend to do shady business.

It's not the first time and it won't be the last time a joke got someone booted.

This is one of the reasons ZOS has a pretty significant image problem. That, and they virtually never reverse any decisions on matters like this no matter how erroneous the actions on the part of ZOS may have been.

The most obvious defense is to just not say something, in a public channel, without context, that can get you banned.

Gold selling will get you banned.

Saying you are doing so in in-game chat, without context, and later claiming it is a joke, will get you banned. Intent over text is almost never conveyed.

Just don't say dumb things to people you do not know.

@opalcity beat me to it. Thanks for sharing that text.

@MilkAndC00kies your friend will need to submit an appeal for this and go through the formal process. If they have already appealed, they can send the ticket number over to me and I can make sure it's in the right place to be handled. But final call on these matters is always held with customer service.

Sucky lesson to learn but how can it be proven he was not meaning it as a joke, it's just something that cannot be proven or? Only way I can think of is for ZoS to go over his account and look for any large gold transfers through vendors or giving to players directly. If there were none found then perhaps the ban could be lifted.

If indeed he was joking it's a painful lesson. If it were me I'd just move on to a different game.

"Did in-fact violate tos..." They don't perma ban without actual proof, just saying. Also, why is he basically admitting to doing it, but you're saying it was only a joke?

the "joke" is that he was "selling gold for litecoin"

    selling gold is permabannable

he can appeal, telling them it was in fact a joke and saying he'll never do it again

his appeal may be accepted or punishment reduced, if he does it again the result will be the same but his appeal will probably not get accepted

Yeah, I know the joke (where there is no proof that's what he said) and that gold selling is bannable. But in the reply he isn't even saying he is joking...Not to mention, again, that they see proof of his guilt and keep the ban.

I agree that it's a very poor appeal/response to the CS rep, if it is in fact a joke he is not communicating it. He should definitely take the appeal process more seriously. The response basically communicates "I am sorry for selling gold, I won't do it again," instead of the OP's "He said he was selling gold for litecoin as a joke." It also says that there is evidence of gold selling "in the system," I'm inclined to not believe the OP's story of a just a joke comment based on the available information, but I wish their friend the best.

First of all his enlish is bad, just as mine secondly he admit he did said that in chat.

They wouldn't ban your friend without concrete proof. It was a terrible joke, yes, but I'm pretty sure ZOS have item and currency logs and wouldn't ban on that alone. If he said that and there was also a weird trade with a big amount of Gold, that could prevent your friend from recovering their account.

I would recommend they attempt to write out their entire appeal in their primary language (which I assume is Hungarian) then use a translator to English.

They also provide support in French, German, Russian, Simplified Chinese, and Spanish as well as Japanese (but if people appeal in Japanese they use a different support link)

There are two possibilities here, that the banned person did in fact sell gold, or that CS used a boiler plate response ("due to the extant and scale of the violation....").

So my question for the OP: are you claiming that CS is acting in bad faith or is your friend in fact, guilty?

He wrote back to the initial mail before even contacting with me and i said he did that wrong too, also i'd like to point out that translate from hunfarian to english with translator is pretty bad when you want translate sentences that are longer than 4-5 word.
