Is shadow cloak bugged?

I made a nightblade and put a point in shadow cloak. The ability says it makes you invisible for 3 seconds. I tried using it right before stealing an item and despite saying I'm invisible people still catch me for theft? Is this supposed to happen? It does not happen if I use an invisibility pot. Only seems to happen with shadow cloak. Very disappointed that the skill does not work as advertised.

Perhaps the 'timing' is just a bit off... because invisibility pots last longer so it gives more time to trigger the 'invisible/visible' status.

Invisible potions were nerfed and won't work now either unless you have a fair amount of stealth bonuses to go along with it. But I don't know why the invisible from cloak works differently than the one from potions. That's always been weird to me. You can force locks but not steal? Doesn't make a lot of sense.
