It doesn't apply. We gather here and discuss ESO, but this isn't a public square type situation.

The forum doesn't have off-topic discussions, and the topic is ESO. Nothing else is permitted, thankfully.

I'd be much more interested in a discussion concerning the astroturfing that takes place around here but we all know where that'll lead.

Things like this can never cover people posting stuff on forums or sites like Facebook. Sites and forums have rules in place to protect their users and prevent them from being exposed to potentially harmful/overly negative content, and no 'law' that's put into place is going to take away the right to moderate content to keep doing that. Free speech does not trump others' safety/health, be it physical, mental, emotional, etc. It's why you can still be arrested if you go into a store and start shouting racial slurs and profane things at people. Freedom of speech doesn't mean you're free to say whatever you want to whoever you want when and wherever you want and not suffer some sort of fallout from it, it just means you have the power to say those things. It doesn't protect you from the consequences of saying them. It also usually is in regards to being able to freely state your opinion on political or religious views/figures without the fear of being arrested or killed because of your opinion and the fact that you're expressing it, not in terms of people wanting to use it to flame, bait, and insult others online in public and/or private forums.
