Accounts are non-transferable under all circumstances.

It is against TOS to share an account even between domestic partners in the same home. Get your own copies.

Won't get you banned as long as you don't share with multiple people from random locations. Just the 2 of you should be totally fine. I travel the world for living, I'm in different country every ~1-2 months, and I share accounts with my GF normally. Even when we're back home and traveling across the country.
Imho, when it's just 2 of you, regularly switching on same accounts, you should be completely fine. The GMs do have some common sense too.
Pretty sure the TOS refers to malicious activity involving more than 1 account, rather than simply restricting it entirely. A different story might be if you're online dating and cannot physically be on the same IP ever. As in my case I can prove that we're indeed family.
Should ZOS have a problem there, you both can still easily claim you're partners just trying to help each other ingame, since they will likely have you prove it via email and IDs, so I really wouldn't worry much about it.

They likely want to be able to help each other on their accounts, rather than just having one and only one account for both to use. I know for a fact that ZOS does have understanding of it as long as it is within close family. The only issue where TOS will be brought up is when something happens on those accounts (eg. Lost items, gold, etc. due to partner dispute etc.), then ZOS will exercise not having to take responsibility for the items/characters etc. in question.
TOS isn't just YOU'LL GET BANNED THIS INSTANT IF YOU DO ANYTHING REMOTELY BAD. They most certainly have access to things that may clearly tell them its just 2 people in love or friends trying to make things easier for each other. As such there is no "threat" to the server, Zenimax, nor other players and the only thing that might happen is that ZOS WON'T HELP YOU WITH RECOVERY. That's why it's in the TOS. You might not be able to appeal for a ban for example. Or lost items/gold/characters etc. That's on your own if you break this rule.
I have appealed on this issue before. It's and it's okay, as long as you're both not doing anything stupid that is critically against the TOS. Exploiting, hacking, cheating, etc. You both have an account of your own, right?
