Stuck in combat - no Crystal Fragments proc

At some point in the past, Crystal Fragments was changed to not proc out of combat. Today I realized that when stuck in combat in PvP (flashing red screen borders, unable to mount or port for minutes etc) I'm not able to get a Crystal Fragments proc. Maybe it's similar with the various Ultimate regeneration passives that only work in combat.
Hopefully this information helps to fix the very annoying stuck in combat bug.
