Promote, upload, transmit, encourage or take part in any activity involving hacking, cracking, phishing, taking advantage of exploits or cheats and/or distribution of counterfeit software and/or Virtual Currency or virtual items. In an effort to continuously improve the Services, You and other players discovering exploits, cheats, cracks or other inconsistencies are required to report them to ZeniMax;"
So was this a glitch/problem caused by ZOS?
Yes.
Does that in any way change the responsibility of players to report that glitch/problem and to cease to use it once discovered?
Nope. You sign the TOS, you agree to not exploit the game and to report glitches and exploits when you find them. If you don't report the exploits/glitches that you find and instead continue to benefit from them, you get to deal with whatever consequences ZOS dishes out (as in the recent situation with trials players cheesing the boss fight in Asylum Sanctorium, where these exact excuses were used, to no avail.).

You are the second person who exploited to make a thread crying about how it's not an exploit. Worried about your account are you?
Taking advantage of a bug for the purposes of gaining something is the definition of an exploit. lol
