No need to create a new faction. We just need to be able to hoist the Jolly Roger.
- A group forms outside Cyrodiil. Can be cross-faction. Crown specifies the group is "Black Flag."
- Group enters Cyrodiil and spawns randomly at one the the Imperial Forts around the map. Not sure how queuing could work, but they should not count toward faction population caps.
- While in Cyrodiil, the Black Flag group is everyone's enemy. They can attack, or be attacked by, all 3 factions. (Are other Black Flag groups enemies as well? Not sure.)
- They can capture keeps and resources. Black Flagged objectives are worth zero points for all factions.
- Black Flag groups can capture scrolls, but not place them anywhere. Instead they will time out as normal.
- Black Flag does not have access zone chat.
- Respawn points are at large Imperial Forts, which now have NPC siege merchants. However, Imperial Forts are not connected by transitus shrines or wayshrines.
- While under a Black Flag, players do not earn standing toward any leaderboards, do not receive RftW mails, and cannot take emperorship even if they have all the ring keeps.

You can already do this with any of the factions, and some do. They are capped at 24 players. Factions can (and do) stack raids. And if that's not enough, with a rogue group, you have the option of 3 faction teaming up and killing them. If the entire server population can't beat one group... I dunno what to say.
