Dying Leaving Coldharbour and Forced-Waypoint - WAI?

I've recently started playing again after a lay-off since 'Unlimited' came out so maybe this is a change I simply haven't noted in patch notes, however, this doesn't seem right to me.

I've been creating and re-creating several characters to decide what I want to play now and so I've got 9 of them through the tutorial instance and into the first city. Of these I've experienced:

1) 4 arrive as they always used to, ie. ALIVE.
2) 5 arrived DEAD.

Now, arriving dead seems a plausible scenario when one considers the basic premise of how our character got to Coldharbour in the first place ... BTW, whatever happened to the cutscene which was played at the beginning (as far as I can recall) showing our execution?

Thing is, even if arriving dead is now WAI, it's still inconsistent.

In three cases the 'Revive Here' option was available, as well as the normal 'Waypoint' and the 'Info' (I forget the text), but in TWO cases the 'revive' option wasn't available because it was requiring the usual Soulgem (which wasn't needed in the other cases), which of course can't be found in the Coldharbour section.

Since I had played the game I realised how to deal with the forced-waypoint created by the requirement for an unavailable Soulgem, but a brand new player could easily be left totally perplexed!
