How the hell do you get to it? I cannot find a way up there and thought maybe I had to go through an area via trespassing to get to it but got killed by a guard in the process and lost all my stolen goods AND have a bounty.

Yes and it is easy enough to spot but getting to it is what was vague.
It's an enviromental puzzle. That's a rather common thematic element to thieving inspired games.0 -

Which is exactly why I figured trespassing (emphasis on passing due to passing through, badum pish
) was a valid suspicion to get to it. Unfortunately that cost me some stolen goods, a few Lockpicks and Rogue Potions, and 1 of those 500 bounty edicts, all but the latter which are pretty easily replaced.
