OK fair enough, but you still need a direct example of their misleading advertising that goes against what I quoted from the support site, otherwise you're unlikely to get anywhere.

Well, go in game, open up the crown store. Listed under 'account upgrades' you'll find the imperial upgrade, where it says (verbatim) "Includes all the awesome perks of the Digital Imperial Edition". The same is on the website advertising. It doesn't matter if they put restrictions in FAQs buried on the website, the description is the description, and what you get isn't that.

(I should add I have explained all of this in my ticket, and I get no direct response to any of it, just told repeatedly that I have to buy it on both servers)

ESO Plus is really the way to go, I honestly don't suggest to anyone to ever buy DLC via crowns based on how it works.

Sorry you had this experience and didn't realize it was limited by server.

OK, so we have your argument. The section in the Crown Store is listed as "Account" and nowhere in the Crown Store does it clarify that Account upgrades are actually server-locked and not account-wide, which is a counter-intuitive circumstance. So you claim misrepresentation of the product based on the fact that the so-called "Account Upgrades" are not account-wide at all, and nothing in the Crown Store tells you this.

ZoS has always stated clearly that crown store purchases are for only one server zone only... I'm sorry you feel like you've been duped. But it happened because you missed the many places that ZoS has emphatically said that.

Yes, but additionally that they previously sold a digital imperial edition upgrade to provide exactly the same benefits, which had no such server restrictions.

You could argue that any reasonable person would expect an account upgrade to apply to their whole account unless otherwise clearly stated in the description, but they explicitly advertise that it gives the same benefits of another product, when it evidently does not.

wow, are you sure the dlc is server bound?

Yes, if you buy Orsinium in EU server you will not have it on the NA server.

Didn't know this... or the fact that Crown Purchases are bound to EU or US..

They certainly did, and those points have got to be the basis of your argument. Yes they have articles that state they are only for the server you purchase them on, and that will likely be their counter-argument, but you have to go specifically looking for that info, and it is not anywhere near the purchase page. I hope at least that this exchange has helped in your formation of a good argument to present, and prepared you for some of the counters that ZOS will throw back at you.

That is essentially it, yes. The description is mostly concerned with the public labelling and advertising (i.e. what is directly used to persuade you to buy it). If it comes to formal complaints to trading authorities, then it's not for me to investigate, to defend, or to argue -- I simply state my full complaint. However, rulings by the Advertising Standards Authority, for example, are public and binding. This is something I would rather not do, hence my attempts to get the issue escalated.

Crown Store purchases are server specific. As such, upgrades like the Imperial upgrade or the DLC game packs are server specific as well. In order to play the content on both servers, you must purchase the content on both servers.
That's a very clear-cut statement, so you'd need to find something which directly counters it in your evidence of misleading advertising.
Having that statement be on the description of the item in the crown store, and not buried in a FAQ on their support system webpage would be a good start...

Agreed. It doesn't help the OP of course, but it would go some way to prevent the problem from occurring again.

Understand you don't need us for anything else really. We can sympathize, we can comment, but it won't get you anywhere further now. (I hope Enodoc helped with confidence on where you stand)

You need to be clear to them, they've been clear with you:

    They won't refund.
They won't make your DLC purchase active on both servers.

->You can push to have your purchase switch server if it was a genuine mistake on your part and is what you want. Explaining the mix-up and confusion. Everyone's human (obviously this is a bit tougher if you went and blamed them for it - they don't legally have to, and if you've alienated them well....).

->You can, as Enodoc stated, find the misleading information (in-game or online) and get refunded through UK Law.

So Imperial Upgrade is just for one character?

Tough it was for the account like Imperial City and Orsinium.

Whether or not the ad/info is misleading IMHO its a rotten way to do business. Ive never seen an xpac/dlc that was bound like that (that doesnt mean other games dont do it, just that I have never seen it done). Im sorry I bought them now as doing so encourages the practice. No more....
