Stealthing Mechanic Broken?

It would seem as though my stealthing mechanic as a nightblade is completely broken.

Firstly, let me start off by saying that I'm not the most experienced PvPer, and I may not fully understand all the mechanics of PvP, but damn my stealth mechanic seems broken.

Secondly, I see other nightblades flow in and out of stealth with ease as well as their ability to stealth flee unimpinged even if I do put a piercing mark on them.

Thirdly, no one in my group or myself will be in combat and there will only be friendlies around and guess what, I still can't go back into stealth.

What is the deal?

P.S. I will say that SOMETIMES it does feel as though the stealth mechanic works properly and as it should. When this is happening I do feel very effective as a nightblade, but unless the stealth mechanism is working properly I tend to be very ineffectual.
