Why are guards unkillable?

ctt13✭Why does everyone have such a problem with killing guards. Pretty sure ZOS made a sneak button, if only I could see the giant analog stick.
If you can stay out of the guards way, you will be fine. Anyway just pay that crippling 40 gold bounty. I'm sure you'll get it back from slaying some enemies.0
