The Justice System seems pretty sound. I can't see what the hold up would be for the PvP portion.

    Yes, death to a guard is no different than death to any other PVE mob. You incur armor degradation.

    From what I understand, you will only be flagged for PvP when you are at the notoriety level that currently makes you KoS, so it will be perfectly possible to be a successful thief without ever getting in danger of being killed by another player. You just have to know what you are doing.

    In previous TES games, the only times I got a bounty was when I wanted to get the achievement (and in Oblivion when I ported to town without taking off the cowl of Nocturnal)
