Immunity to damage as well as CC?

I'm a nightblade so I usually begin an attack with surpise attack from stealth. With the new random CC immunity that NPCs now have (intentional or not?) they also seem to be immune to damage on a second hit of surpise attack, not just immunity from the stun. For example, I attack, stealth and attack again and the second attack doesn't do anything to the NPC.
