Is Vicious Death not working correctly?

I've never really paid attention to the VD proc and whether it is activating like it should. It does not say anything about there being a cool down so I'm assuming that's not the issue.
I was testing a new build on some trash mobs in Fungal Grotto and noticed that even though the mobs were grouped closely together almost on top of each other when one died nothing happened to any of the others a lot of the time. Actually quite a LOT of the time. I tested this extensively and it was actually rare for anything to happen at all. Maybe one out of five times it actually did anything at all, the other four just the target mob died.
If i recall my tool tip said it should proc for around 17k to all enemies as I pushed my weapon and spell damage to the limit with the new build. I'm thinking this might be the 5 meter bug that occurs so much of the time with other things. Anyone else tested this lately? I know it does work in Cyrodill as I die from it sometimes.
