@ZOS_BrianWheeler mentioned on #BethesdaGameDays Twitch broadcast that the Daedric Artifact will spawn near the alliance with the lowest points.
Usually the alliance with lowest points isn't the alliance which has emperor, so the situation you are describing will be very rare.
Though ZOS can add an additional rule that if there is an emperor in group, a player can't pick up the weapon.

Here's how I see it going down. If a guy is carrying volendrung and is crowned emperor, the weapon will disappear and he'll have his normal weapons equipped but the volendrung skill bar won't go away, so he tries reloading ui; doesn't work. Tries porting; doesn't work. So he reloads his game, kicked from cyrodiil. Queue 78. By the time he gets back into the campaign he's lost emp.

So much theory into the bad none into the fun factor. The eso community should imo imbrace an element like this to add to PvP.
Abuse of the weapon - is to exploit certain skills. Politics and views / perceptions shouldn't be a factor in a change or nerf.
Balanced yes - Should it wipe zergs of people ? Absoluty that's the point - if you zerg there will be consequences now. And it's not going to last long so everyone is getting paranoid over this ?
Why I have no idea - let's just have some fun with it and if you see the person have it, run don't try to 1v1 him or think you can solo kill him/her. It's supposed to be overpowered and cheesy and funny and enjoyable.
